Talent IQ Terms of Service

These Terms are a contract between [Legal entity name] ("Talent IQ", "we") and the adult parent or legal guardian who creates an account ("you"). By creating an account or using Talent IQ you accept them. If you do not accept them, do not use the service.

1. What Talent IQ is

Talent IQ is an AI-assisted parent-child discovery companion. It offers age-adapted AI conversations, optional Voice Mode, qualitative Talent Signals with supporting evidence, longitudinal memory across sessions, Parent Notes, a Discovery Journal, Together Time activities, Challenges, and generated Reports. Detailed observations are available in Parent Mode; Child Mode is deliberately simple and encouraging.

2. What Talent IQ is not

  • Talent IQ is not an IQ test and produces no IQ score, test score, grade or ranking.
  • Talent IQ is not a diagnostic tool.
  • Talent IQ does not provide medical, psychological, legal or educational diagnosis, therapy, treatment or professional advice.
  • Talent IQ does not guarantee any future talent, career, academic or developmental outcome.
  • AI-generated observations are tentative and informational, expressed only as Emerging Pattern, Frequently Observed, Worth Exploring or Not Enough Evidence Yet.
  • You, the parent, remain responsible for how you interpret and act on anything the service shows you. For health, developmental, educational or legal decisions, consult a qualified professional.

3. Accounts, eligibility and child profiles

Accounts are for adults aged 18 or over who are the parent or legal guardian of each child added. You are responsible for the accuracy of your account details, for keeping your credentials secure, and for all activity under your account. Children do not have their own logins and cannot purchase anything.

Each child profile is created and controlled by you. Before a child profile is used for cloud AI processing you must record parental consent on the Parental Consent page. You may withdraw consent at any time in Settings, which stops further AI processing for that child.

4. Parental responsibility

Talent IQ is intended to be used with your involvement. You decide which features are enabled for each child (including Voice Mode, uploads, journal saving and personalised challenges), you decide what is saved, and you decide when data is deleted. You are responsible for supervising your child's use of the service and for the content you or your child enter.

5. AI features and their limits

Conversations, summaries, Talent Signals, challenge recommendations and Reports are generated with artificial intelligence, processed server-side by our AI service provider. AI output can be incomplete, inconsistent or wrong. It is not a professional assessment. Where the AI service is unavailable, Talent IQ falls back to a local rules-based conversation mode with reduced capability.

Safety rules run before and after generation, but no automated safety system is perfect. If a conversation raises a concern, use your judgement as the parent and contact a qualified professional or emergency services where appropriate.

6. Voice features

Voice Mode is off unless you enable it and record voice consent. When enabled, audio recorded in the browser is sent to our servers, forwarded to the AI provider for transcription, and spoken replies are generated and streamed back. Raw audio is not stored by Talent IQ; only transcript text and derived observations are saved. Child Mode cannot enable Voice Mode or override your setting.

7. Your content and intellectual property

You and your child keep ownership of the content you provide: messages, Parent Notes, journal entries, reflections and uploads ("Your Content"). You grant Talent IQ a limited licence to host, process and transmit Your Content solely to operate the service for you — including sending the necessary context to our AI provider — and for no other purpose. We do not use Your Content to advertise to you or your child.

Talent IQ, its software, design, methodology, signal taxonomy, prompts and printed materials remain our intellectual property. Reports and observations generated for your family are yours to keep, export and share privately. You may not copy, resell, or build a competing product from the service, its outputs or its methodology.

8. Subscriptions, Conversation Credits and payments

AI usage is metered in Conversation Credits. The rules are:

  • A subscription plan may include up to 20 Conversation Credits per month. No plan includes more.
  • Included monthly credits reset at the start of each billing cycle. Unused included credits do not roll over.
  • Purchased credits are tracked separately and are not removed by the monthly reset. Included credits are always consumed before purchased credits.
  • Credits are consumed by eligible AI operations (conversation turns and summaries, Parent Mode questions, Together Time turns, voice transcription, spoken replies, challenge recommendations and report generation). Costs per operation are set server-side and may change; we will not change them retroactively for credits already spent.
  • If a paid request fails before producing usable output, the system automatically returns the credit to your balance. Duplicate submissions of the same request are not charged twice.
  • Credits have no cash value, are not a currency or stored-value instrument, cannot be transferred between accounts, and cannot be redeemed for money except where required by law.

Payments for credit packs are processed by Stripe. We do not receive or store your full card details. Subscription fees and pack prices are shown before purchase. Except where consumer law in your country gives you a refund or withdrawal right, purchases of credits are final once the credits are added to your account; contact us at privacy@talentiq.app if you believe you were charged in error and we will review it. You may cancel a subscription at any time; cancellation stops future renewals and takes effect at the end of the paid period.

9. Acceptable use

You agree to use Talent IQ only as intended, and not to:

  • attempt to obtain private information about any child, including through the AI;
  • submit or generate harmful, exploitative, hateful or violent content;
  • submit, request or generate any sexual content involving minors — this results in immediate termination and, where required, reporting to authorities;
  • harass, abuse, threaten or endanger any person;
  • use the service for any illegal purpose;
  • attempt to bypass, disable, prompt-inject or otherwise defeat the safety controls, age adaptations or parent permissions;
  • use bots, scripts, scraping or other automation to abuse the AI endpoints, or attempt to exceed rate limits;
  • share, resell or pool an account in order to bypass Conversation Credit limits;
  • reverse engineer, probe or interfere with the service, its security or another family's data.

Create a profile only for a child you are the parent or legal guardian of. Do not enter a child's full legal name, address, school, phone number or other identifying details — the product is designed not to need them.

10. Suspension and termination

We may suspend or terminate an account that breaches these Terms, that poses a safety or security risk, or where required by law. Where reasonable and lawful, we will warn you first and give you an opportunity to export your data. You may stop using Talent IQ at any time and delete individual child data or your whole account from Settings. Deleting your account ends these Terms; sections that by nature survive (intellectual property, disclaimers, liability, governing law) continue to apply.

11. Service availability and changes

The service is provided on an ongoing but not uninterrupted basis. Maintenance, provider outages, network failures and changes to third-party AI or payment services can affect availability, latency and feature behaviour. We may add, change or remove features, and we may update these Terms; material changes will be reflected in the version and dates at the top of this page, and notified where the law requires.

12. Disclaimers

To the maximum extent permitted by law, Talent IQ is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that AI output will be accurate, complete, consistent or suitable for any decision. Nothing in these Terms excludes rights you have as a consumer that cannot lawfully be excluded.

13. Limitation of liability

To the maximum extent permitted by law, Talent IQ and its suppliers are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits, goodwill or educational or developmental outcomes, arising from your use of or reliance on the service or its AI output. Our total aggregate liability for any claim is limited to the greater of the amounts you paid us in the twelve months before the claim, or fifty US dollars. Nothing here limits liability for fraud, death or personal injury caused by negligence, or any liability that cannot lawfully be limited.

14. Indemnity

You agree to indemnify Talent IQ against claims arising from your breach of these Terms, your misuse of the service, or your creation of a child profile for a child you are not the parent or legal guardian of, except to the extent caused by us.

15. Privacy

Our handling of personal data, including children's data, is described in the Privacy Policy, which forms part of these Terms. Consent for each child profile is recorded through the Parental Consent page.

16. Governing law and disputes

These Terms are governed by the laws of [Governing law jurisdiction], without regard to conflict-of-law rules. Disputes will be resolved in the courts of [Dispute resolution venue], unless mandatory law in your country of residence gives you the right to bring proceedings elsewhere. Before starting formal proceedings, please contact us so we can try to resolve the issue directly.

17. General

These Terms, together with the Privacy Policy and any consent you record, are the whole agreement between us. If a provision is unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor of our business.
